Senate Vote in July Marks Start of Democratic Debate Over the Future of the Legal Status of Marriage In America

102  WASHINGTON, DC - Today, the Alliance for Marriage welcomed the announcement of a pending Senate vote on AFM’s Marriage Amendment in July. “This marks the beginning of a democratic debate that AFM hoped to create when we drafted the marriage amendment,” said Matt Daniels, president of the Alliance for Marriage. “Our goal has always been to allow the critical issue of the future of marriage in America to be resolved democratically, rather than through the courts.”

Most legal experts expect that the recent judicial invalidation of the marriage laws of Massachusetts will eventually lead to lawsuits designed to overturn marriage laws across the country. For example, the Boston Bar Association has publicly called for “federal constitutional claims” to be brought against all state and federal marriage laws on the basis of the Massachusetts court action.

“Most Americans believe that gays and lesbians have a right to live as they choose. But they don’t believe they have a right to redefine marriage for our entire society,” said Daniels. “Americans want our laws to send a positive message to children about marriage, family and their future.”

“The constitutional problem created by almost a decade of activist lawsuits to destroy our marriage laws demands a constitutional fix,” Daniels added. “AFM’s marriage amendment has been introduced with bi-partisan sponsorship in two successive sessions of Congress in order to protect the common sense view of marriage shared by the vast majority of Americans of every race, color and creed.”

“AFM’s Federal Marriage Amendment will protect marriage while leaving all issues of benefits to the democratic process in the states,” Daniels said. “AFM believes this centrist approach embodied in our amendment offers hope of a democratic resolution to a debate that has been forced on the American people by the courts.”
